O papel da administração pública na fiscalização e controle das organizações da sociedade civil

Abstract

This paper aims the analysis of the role of public administration when it comes to supervision and control of the application of public resources by civil society organizations, considering the regulatory framework of the third sector and the incidence of administrative improbity law in these cases. The study was developed based on bibliographical and documentary research, including literature review and consultation on legislation related to the theme. Firstly, the context of the emergence and evolution of the third sector in Brazil is presented. Next, the relatonship between the third sector organizations and the public sector is analyzed. At last, we discuss the incidence of the Law of Administrative Improbity in cases of transfer of public resources to these organizations, highlighting the measures in which the public power strives to avoid the diversion of resources, through supervision and control. The final considerations point out that the advancement of Legislation has brought a greater balance in the relations of Civil Society Organizations with the Public Administration in all powers ; thus enabling NGOs to accomplish and carry out actions in favor of society.
