| Resumo: | O presente trabalho examina o Tribunal do Júri, uma Instituição prevista como garantia fundamental na Constituição Federal de 1988, competente para julgar os crimes dolosos contra a vida. Ocorre que analisando as condições em que se originou o Julgamento Popular nota-se que elas não são condizentes com a realidade atual, fazendo com que sua estrutura se torne inadequada aos Princípios que norteiam o Estado democrático de Direito. Desta forma busca-se trazer os argumentos utilizados para legitimação do Instituto com o fito de questioná-los, fundamentando uma necessária revisão do raciocínio acerca do tema, em busca da modernização processual penal. Não obstante, procura-se indicar alternativas que objetivam mudanças procedimentais, a fim de reformar a estrutura do Tribunal do Júri e de adequá-lo aos parâmetros do Estado democrático de Direito. |
| Abstract: | This work examines The Jury´s Court, an institution foreseen as fundamental guarantee in The Federal Constitution of 1988, qualified to judge the willful crimes against life. Analyzing the conditions that Popular Judgment was created they happen to be not consistent with the current reality, turning its structure inadequate to the Today‟s Legal Order. In this way, it seeks to bring the arguments used to legitimize the Institute with the purpose of questioning and deconstructing them, grounding a necessary revision of the legal reasoning, in search of criminal procedural modernization. Nonetheless, it looks to find alternatives that aim at procedural changes, in order to reform the structure of the Jury and to adapt it to the current democratic State of Law. |
