| Resumo: | O presente artigo propõe uma análise acerca do prazo máximo de duração das medidas de segurança no Brasil, abordando o recente posicionamento sumulado pelo Superior Tribunal de Justiça em seu verbete sumular número 527, buscando concluir se configura ou não a melhor alternativa do ponto de vista teórico do Direito Penal. A abordagem se inicia com uma breve exposição sobre o instituto da medida de segurança no ordenamento jurídico brasileiro. Em um segundo momento, expõe-se a problemática do prazo máximo de duração das medidas de segurança, trazendo as posições do Superior Tribunal de Justiça e do Supremo Tribunal Federal sobre a matéria. Após, apontam-se as razões para a inaplicabilidade do entendimento fixado pelo STJ em sua súmula número 527. Por fim, são sugeridas algumas alternativas para aplicação do prazo máximo de duração da medida de segurança. |
| Abstract: | The present article proposes an analysis of the duration of the criminal treatment provided to the mentally insane in Brazil, addressing the recent position established by the Superior Court of Justice, seeking to conclude whether or not it constitutes the best alternative from the theoretical point of view of Criminal Law. The approach begins with a brief exposition about the criminal treatment provided to the mentally insane in Brazil. In a second moment, brings the problem of the duration of the security measures, exposing the positions of the Superior Court of Justice and the Federal Supreme Court about the matter. After, the reasons for the inapplicability of the position established by the Superior Court of Justice in its precedent number 527, concluding with some alternatives for the maximum duration of the security measure. |
