A coleta seletiva em Juiz de Fora: uma análise dos instrumentos da gestão democrática da cidade e da extrafiscalidade da taxa de coleta de resíduos sólidos

Abstract

The practice of separating household solid waste according to its composition and performing the selective waste collection allows the viability of recycling, considered by the National Solid Waste Policy as one of the forms of environmentally appropriate disposal. The study of selective collection is important because it allows the defense and protection of the healthy environment, fundamental right provided in the article 225 of the Federative Republican Constitution. Thus, an analysis is made of the possibility of expanding the dialogue between the Public Power and the community about the selective waste collection, through the democratic management instruments provided by the City Statute; and the proposal of the reduction of the solid waste collection rate at the time of the selective collection. The theoretical framework adopted is neoconstitutionalism, considering a constitutional State of rights, instead of strictly binding to the law and of merely formal constitutions. The research is exploratory, as well as bibliographical and documentary. The objective is to carry out a critical and constructive analysis, therefore, critical-dialogical.
