Resumo:	O presente trabalho acadêmico objetiva analisar a nova tese do STF sobre desaposentação, estruturada no julgamento dos Recursos Extraordinários 661.256, 827.833, e 381.367. Este estudo se fará através do método de pesquisa qualitativa consistente na análise documental do julgado do STF, de artigos, livros, revistas acadêmicas e da codificação pátria, elaborados sobre o assunto central em pauta. Mostra-se indispensável análise dialética das fontes deste trabalho em virtude da necessidade de interpretação dinâmica inerente às questões que envolvem o instituto. Assim, responderemos se há coerência no julgado do STF quanto à interpretação do instituto da desaposentação no que tange ao seu não reconhecimento como direito previdenciário, bem como seus fundamentos legais, em especial os que consideram a ilegalidade deste instituto.
Abstract:	This academic paper aims to analyze the STF’s new thesis on disapproval, structured in the judgment of Extraordinary Remedies 661,256, 827,833, and 381,367. This study will be done through the qualitative research method, consisting of the documentary analysis of the STF judgment, of articles, books, academic journals and country code, elaborated on the central subject in question. A dialectical analysis of the sources of this work is indispensable because of the need for a dynamic interpretation inherent in the issues surrounding the institute. Thus, we will answer whether there is consistency in the judgment of the Supreme Court regarding the interpretation of the institute of disapproval as regards its non-recognition as social security law, as well as its legal grounds, especially those that consider the illegality of this institute.
