Resistir à “paz”: uma análise sobre as Unidades de Polícia Pacificadora (UPPs)

Abstract

This work intends to promote a study on the Unidades de Polícia Pacificadora (UPPs), a public security policy implemented in Rio de Janeiro's favelas by the Brazilian government. The paper starts by providing commentary on the decree responsible for regulating the UPPs policy (Decreto nº 44.177/2013; Decreto nº 45.186/2015), situating the project in the history of public security policies, with a special emphasis on how political games were responsible for the construction of the favela as a stigmatized place in the collective imagination. Moreover, it examines the influence of big international events on the creation of the UPPs, and reflects about the "logic of war" and the military character of police intervention, through a dialog with the theory of the permanent state of exception. It concludes with a discussion about the possibility of the recognition of a right of resistance, to be exercised by the people in the favelas, examining the legal-philosophical tradition that permeates the debate, choosing Roberto Gargarella's theory of legal alienation as an alternative for the reality in the favelas, since its residents are face continuous and systematic violations on their basic rights as an outcome of the UPPs policy.
