| Resumo: | O presente estudo tem por finalidade o questionamento sobre a responsabilidade penal da pessoa jurídica, tendo em vista a grande controvérsia sobre esse tema atualmente. Dessa forma, será averiguado o contexto de seu surgimento, para constatar o motivo da intervenção do Direito Penal nesse novo ramo. Logo após, será verificado se o nosso ordenamento previu esse instituto de responsabilização, bem como se, uma vez admitido, haveria compatibilidade com o Direito Penal brasileiro. Posteriormente, será feita uma análise jurisprudencial e doutrinária sobre as correntes e entendimentos sobre o tema, através de uma explanação sobre os principais argumentos adotados por cada posicionamento. Por fim, levando em consideração a categoria de direito fundamental consagrada ao meio ambiente pela Constituição Federal de 1988, far-se-á uma análise crítica para aferir se o Direito Penal é realmente adequado no combate aos crimes ambientais, considerando as diversas outras medidas protetivas previstas em nossa legislação que também podem auxiliar no combate aos danos ambientais. |
| Abstract: | This study aims at questioning on criminal liability of legal entities, considering the great controversy on this issue today. Thus, it will be examined the context of its emergence to find the reason for the intervention of the criminal law in this new field. Soon after, it will be checked if our law foresaw this accountability institute, as well as, once admitted, there would be compatibility with the Brazilian Criminal Law. Subsequently a jurisprudential and doctrinal analysis of the current and understandings on the subject will be made through an explanation of the main arguments adopted by each team. Finally, taking into account the fundamental right category devoted to the environment by the Federal Constitution of 1988, far-there will be a critical analysis to assess the actual effectiveness of criminal law in the fight against environmental crimes, considering the various other planned protective measures in our legislation to assist in the fight against environmental damage. |
