| Resumo: | A cultura da inovação presenteia o direito com inúmeras oportunidades e incontáveis desafios. No que tange às startups, objetiva-se demonstrar o quanto o conhecimento acerca do contexto jurídico brasileiro e as implicações dos mecanismos legais existentes podem ser úteis na construção, consolidação e expansão de um negócio. Mais que isso, refletir-se-á sobre o valor da advocacia preventiva e da responsabilidade social empresarial, com o devido desdobramento das perspectivas que ambas trazem na atração de investimentos, indispensável para alavancagem de uma empresa e no reconhecimento da identidade coletiva, seja ela corporativa ou não. Para tanto, a teoria institucional de Honneth será adotada, vislumbrando-se o impacto que as startups podem ter nas comunidades em que estão inseridas. |
| Abstract: | The culture of innovation provides law with many opportunities and countless challenges. Regarding startups, the objective is to show how the knowledge about Brazilian legal context and the implications of existing legal mechanisms can be useful in business construction, consolidation and expansion. Furthermore, it will be reflected on the value of preventive law and corporate social responsibility, with due deployment of perspectives that both bring in attracting investments, essential to leverage a company and in recognition of collective identity, be it corporate or not. Therefore, Honneth’s institutional theory will be adopted, aiming the startups and the impact they may have on the communities in which they operate. |
