| Resumo: | O presente trabalho tem por escopo realizar uma reflexão histórica acerca dos homicídios de trânsito, destacando-se o estudo comparado entre a forma com que se deu o processo de urbanização e a necessidade de evolução da legislação de trânsito do Brasil. Busca-se analisar a controvérsia existente sobre a tipificação dos crimes de trânsito, notadamente quando o veículo automotor era conduzido em alta velocidade e/ou por indivíduo embriagado. Para tanto, fez-se necessário a abordagem teórica dos conceitos técnicos-jurídicos de dolo e culpa, bem como das diversas decisões conflitantes proferidas pelos tribunais superiores dando ensejo à tão repelida insegurança jurídica. Por fim, objetiva-se evidenciar o paralelo entre os referidos julgados e a notável influência externa (midiática, política e social). |
| Abstract: | This work is scope conduct a historical reflection about traffic homicides, highlighting the comparative study between the way that gave the urbanization process and the need for evolution of the traffic laws of Brazil. Seeks to analyze the controversy over the classification of traffic offenses, especially when the motor vehicle was driven at high speed and / or intoxicated individual. Therefore, it was necessary to the theoretical approach of the technical and legal concepts of intent and guilt, as well as the various conflicting judgments given by higher courts giving rise to legal uncertainty as repelled. Finally, the objective is to show the parallel between the courts and referred the outstanding external influence (media, political and social). |
