Homicídio de trânsito: entre a técnica jurídico-penal e o clamor público

Abstract

This work is scope conduct a historical reflection about traffic homicides, highlighting the comparative study between the way that gave the urbanization process and the need for evolution of the traffic laws of Brazil. Seeks to analyze the controversy over the classification of traffic offenses, especially when the motor vehicle was driven at high speed and / or intoxicated individual. Therefore, it was necessary to the theoretical approach of the technical and legal concepts of intent and guilt, as well as the various conflicting judgments given by higher courts giving rise to legal uncertainty as repelled. Finally, the objective is to show the parallel between the courts and referred the outstanding external influence (media, political and social).
