| Resumo: | A presente monografia busca investigar e problematizar o surgimento, em nossa sociedade, do direito ao esquecimento no contexto das transformações sociais impulsionadas pela revolução tecnológica e informacional das últimas décadas. Para tanto, utilizou-se da teoria da evolução do conceito de privacidade adotada por Stefano Rodotà, na medida em que traduz a mudança do paradigma por meio do qual é analisada a inviolabilidade da vida privada na pós-modernidade. Desta forma, partindo-se de premissas como a historicidade dos Direitos Fundamentais e sua constante evolução interpretativa e a da proteção da dignidade da pessoa humana como cláusula geral aberta, analisou-se a existência do direito ao esquecimento aplicado à internet, apontando sua presença em diversos dispositivos legais do ordenamento brasileiro. Objetivou-se, ainda, traçar os critérios de sua aplicação frente às liberdades constitucionalmente constituídas e analisar importantes precedentes sobre o tema. |
| Abstract: | This monograph aims to investigate and discuss the rise in our society of the right to be forgotten, in the context of social change driven by technological and informational revolution of recent decades. Therefore, it used the evolution of privacy concept theory adopted by Stefano Rodotà wich reflects the change of paradigm through which the inviolability of private life is analyzed in postmodernity. Thus, starting from premises like the Fundamental Rights historicity and its constant interpretative change and the protection of human dignity as na open general clause, it analyzed the existence of the right to oblivion applied to internet, indicating its presence in various legal provisions of the brazilian legal system. The objetive was also to draw the criteria for its application front constitutionally established freedoms and to analyze important precedents on the subject. Keywords: Private life. Inviolability.
