| Resumo: | O presente trabalho pretende discorrer acerca da legitimidade para recebimento dos créditos trabalhistas de empregado falecido que não os recebeu em vida, estabelecendo análise acerca da sucessão dos créditos trabalhistas à luz da Lei nº 6.858/80 em contraposição à sucessão legítima prevista no Código Civil. Pretende-se analisar se realmente a aplicação da Lei nº 6.858/80 atende a sua finalidade, se a mesma encontra-se atualizada e se a sua aplicação não vem a ser prejudicial face aos direitos sucessórios previstos na lei civil, gerando injustiças, ou mesmo alguma inconstitucionalidade diante das disposições previstas nos artigos 5º, inciso XXX, e 227, § 6º, da Constituição Federal. |
| Abstract: | This work intends to discuss about the legitimacy for deceased workers receiving labor credits that they didn’t get in life, establishing analysis of succession in relation to labor credits according to the law number 6.858/80 in contrast to the legal succession specified in Civil Code. It intends to analyze if the application of the law number 6.858/80 truly serves its purpose, if it is updated and if its application is not harmful compared to the succession rights determined by civil law, causing any injustice, or even some unconstitutionality before the articles 5, subsection XXX, and 227, paragraph 6, of the Federal Constitution. |
