Abstract

This thesis aims to analyze the possibility of applying the institute of excuses acquittals to the families of the contemporary world, demonstrating that the concept of family has changed over time, no longer being something "cast" as once in the patriarchal model. It will be shown as the institute no longer achieves its goals effectively for which it was created, promoting true injustices since the modern family and the harmonious family environment is far beyond the standard structure, consisting of father, mother and children . Are examples of contemporary families data that have the features that the legislature intended to protect when in the preparation of absolving excuses, without having any kind of relationship. Today, with the demands of society and the diversity of families, the feeling of affection between people who cohabit is in various types of villas and these will be the standard features to determine the existence or not of a family to be protected . We demonstrate how this type of family is also worthy of the boon of absolving excuses and so will be proposed at the end, a change in the law in order to create a solution so that such mistakes do not happen again and that the true family environment is effectively protected so effective, without causing injustice. It will be used for both the literature method of consultation with authorities in the matter of argument.
