Title: Ampliação do instituto das escusas absolutórias ao modelo familiar contemporâneo

Resumo: A presente monografia visa analisar a possibilidade de aplicação do instituto das escusas absolutórias às famílias do mundo contemporâneo, demonstrando que o conceito de família modificou com o passar do tempo, não mais sendo algo “engessado” como em outrora no modelo patriarcal. Será demonstrado como o referido instituto não mais alcança seus objetivos de forma eficaz para os quais foi criado, promovendo verdadeiras injustiças uma vez que a família moderna e o harmonioso ambiente familiar encontra-se muito além da estrutura padrão, composta por pai, mãe e filhos. Serão dados exemplos de famílias contemporâneas que possuem as características que o legislador pretendeu proteger quando na elaboração das escusas absolutórias, sem contudo possuírem qualquer tipo de parentesco. Hoje, com as demandas da sociedade e com a diversidade de famílias, o sentimento de afeto entre as pessoas que coabitam encontra-se nos mais diversos tipos de moradias e serão estas as características padrão a determinar a existência ou não de uma família a ser protegida. Demonstraremos assim que esse tipo de família também é merecedora da benesse das escusas absolutórias e assim será proposto ao final, uma mudança na lei a fim de criar uma solução para que tais erros não mais ocorram e que o verdadeiro ambiente familiar seja efetivamente protegido de forma eficaz, sem causar injustiças. Será usado para tanto o método de consulta bibliográfica com argumento de autoridades no assunto.
Abstract: This thesis aims to analyze the possibility of applying the institute of excuses acquittals to the families of the contemporary world, demonstrating that the concept of family has changed over time, no longer being something "cast" as once in the patriarchal model. It will be shown as the institute no longer achieves its goals effectively for which it was created, promoting true injustices since the modern family and the harmonious family environment is far beyond the standard structure, consisting of father, mother and children . Are examples of contemporary families data that have the features that the legislature intended to protect when in the preparation of absolving excuses, without having any kind of relationship. Today, with the demands of society and the diversity of families, the feeling of affection between people who cohabit is in various types of villas and these will be the standard features to determine the existence or not of a family to be protected . We demonstrate how this type of family is also worthy of the boon of absolving excuses and so will be proposed at the end, a change in the law in order to create a solution so that such mistakes do not happen again and that the true family environment is effectively protected so effective, without causing injustice. It will be used for both the literature method of consultation with authorities in the matter of argument.
