| Resumo: | O estudo analisa a guarda compartilhada como um instituto jurídico contemporâneo, questionando se sua aplicação efetivamente prioriza o melhor interesse da criança ou se perpetua conflitos parentais, servindo como extensão do divórcio. A pesquisa fundamenta-se na Constituição Federal de 1988, no Estatuto da Criança e do Adolescente (ECA) e na legislação civil, destacando a mudança do modelo de guarda unilateral para o compartilhado. Examina-se a possibilidade de instrumentalização da criança em disputas judiciais, a importância da oitiva do menor e os impactos da alienação parental. O trabalho enfatiza a necessidade de aprimoramento legislativo e práticas judiciais que garantam a proteção integral dos direitos da criança e do adolescente. |
| Abstract: | This study analyzes shared custody as a contemporary legal institution, questioning whether its application effectively prioritizes the best interest of the child or perpetuates parental conflicts, serving as an extension of divorce. The research is based on the 1988 Federal Constitution, the Statute of the Child and Adolescent (ECA), and civil legislation, highlighting the shift from the sole custody model to shared custody. It examines the possibility of the instrumentalization of the child in judicial disputes, the importance of hearing the minor, and the impacts of parental alienation. The study emphasizes the need for legislative improvements and judicial practices that ensure the comprehensive protection of the rights of children and adolescents. |
