| Resumo: | O presente trabalho analisa a penhora de criptomoedas no direito brasileiro, com foco na sua viabilidade ou não, e nos desafios procedimentais enfrentados pela execução civil nessa temática. Diante da crescente adoção de criptoativos, questiona-se a possibilidade do enquadramento jurídico das criptomoedas e sua respectiva constrição patrimonial. Para tal, busca entender as características das criptomoedas e então discutir as alternativas de classificação para a penhora. A partir de uma análise ampla, acredita-se ser viável a penhora de criptomoedas quando estas estiverem sob o domínio de exchanges, embora haja desafios e oposições para tal efetivação. |
| Abstract: | This paper analyzes the attachment (seizure) of cryptocurrencies under Brazilian law, focusing on its feasibility and the procedural challenges faced by civil enforcement in this context. In light of the growing adoption of crypto-assets, the study questions the legal classification of cryptocurrencies and the possibility of their patrimonial constraint. To this end, it seeks to understand the characteristics of cryptocurrencies and then discuss the possible classifications for their seizure. Based on a broad analysis, it is believed that the attachment of cryptocurrencies is feasible when they are under the control of exchanges, although there are challenges and objections to its implementation. |
