| Resumo: | O presente trabalho objetivou uma análise da atuação do Supremo Tribunal Federal perante o Direito do Trabalho no Brasil. Dessa forma, inicialmente, levantou-se sobre o Desenho Institucional e os fatores de influência que permeiam o Tribunal, além do contexto político em que este está inserido. Posteriormente, foi feita uma revisão bibliográfica entre diferentes autores que apontam como e quando o STF começou a decidir contra o trabalhador e as decisões do Tribunal Superior do Trabalho. Ademais, procurou-se delimitar as semelhanças encontradas nos estudos dos autores analisados. Por fim, foi feita uma análise jurisprudencial de importantes temas sobre Direito do Trabalho que o STF decidiu nos últimos anos. Pretendeu-se, assim, analisar criticamente, com base em bibliografia e jurisprudência previamente selecionada e qualitativamente tratada, como o STF promove o desmonte do Direito do Trabalho nos últimos anos. |
| Abstract: | The present work aimed to analyze the performance of the Supreme Federal Court in relation to Labor Law in Brazil. Thus, initially, an investigation was conducted on the Institutional Design and the influencing factors that permeate the Court, in addition to the political context in which it is inserted. Subsequently, a literature review was conducted among different authors who point out how and when the Supreme Federal Court began to rule against the worker and the decisions of the Superior Labor Court. Furthermore, efforts were made to delimit the similarities found in the studies of the analyzed authors. Finally, a jurisprudential analysis was carried out on important topics related to Labor Law that the Supreme Federal Court decided on in recent years. The intention was, therefore, to critically analyze, based on previously selected and qualitatively treated bibliography, how the Supreme Federal Court has been dismantling Labor Law in recent years. |
