| Resumo: | O presente trabalho tem como objetivo fazer uma análise sobre o instituto do juiz das garantias inserido no ordenamento jurídico brasileiro por meio da Lei Nº 13.964 de 2019, por meio dos arts. 3-A ao 3-F do Código de Processo Penal, e sua relação com o princípio norteador do processo penal da imparcialidade do juiz. Será abordada a teoria da dissonância cognitiva para estabelecer o paralelo entre a parcialidade do juiz que atua na fase de investigação para decidir na fase processual. Portanto, abordarei a necessidade do instituto, concluindo como a referida lei é fundamental para alcançar um processo penal que esteja de acordo com os princípios e garantias fundamentais, garantindo o respeito ao princípio da imparcialidade do juiz. O trabalho foi desenvolvido por meio de revisão bibliográfica utilizando-se o método dedutivo de pesquisa. |
| Abstract: | This paper aims to analyze the institute of the judge of guarantees inserted into the Brazilian legal system through Law 13,964 of 2019, through arts. 3-A to 3-F of the Code of Criminal Procedure, and its relationship with the guiding principle of criminal procedure of the judge's impartiality. The theory of cognitive dissonance will be addressed to establish the parallel between the partiality of the judge who acts in the investigative phase to decide in the procedural phase. Therefore, I will address the need for the institute, concluding how this law is fundamental to achieve a criminal process that is in accordance with the fundamental principles and guarantees, guaranteeing the respect for the principle of the judge's impartiality. The work was developed through a bibliographic review using the deductive research method. |
