Inteligência artificial: o deepfake e seus impactos no Direito de Personalidade, à luz do Direito Brasileiro

Abstract

The present study aims to carry out an analysis of what the so-called Artificial Intelligences (AI's) are, what they are capable of and their risks to society in contemporary times. A historical context of its emergence, advancement and popularization in the present day was carried out, in addition to presenting concepts of this innovative technology, applying concepts for a better understanding, through scientific articles on the subject. After the topic, the work focused on Deepfakes, a technology that is capable of forging videos that pose fictitious situations where individuals have their faces changed through superimposition, through the AI system. We sought to conceptualize what they are, how they work, their emergence and popularization, in addition to the impacts they cause for online users. In order to measure the impact that Deepfakes cause, the present study established a parallel between the impacts of this technology with personality rights, how they are impacted and how they are at risk. Furthermore, a research was carried out by Law Projects that aim to combat this growing problem that permeatesmodernity, in addition to technical studies and research centers that aim to solve the situation and establish adequate uses for Artificial Intelligence. Finally, it is concluded that despite the absence of express laws to deal with the topic, the legislature already understands that AI's are a risk if they are not protected, and is already taking measures to fill these gaps.
