A responsabilidade civil no abuso de direito à liberdade de expressão

Abstract

This article will explore the topic of civil liability in the abuse of the right to freedom of expression, mainly in the digital sphere. To this end, a study will be conducted on the conflict of fundamental rights and what techniques are used to solve them. From this, it will be examined how the exercise of the aforementioned right becomes abusive, as well as how its effects operate in the legal sphere. Finally, the abuse of the right to express oneself will be analyzed in modernity, through concrete and current cases. The aim is, with the work, to understand if it is legal and legitimate to hold accountable those who exceed their fundamental right of freedom of thought and if this responsibility could be considered a form of censorship. For this, a bibliographical and doctrinal review was carried out.
