| Resumo: | Sob respaldo do art. 82 do Código Civil brasileiro, os animais são considerados bens móveis suscetíveis de movimento próprio, tendo tal concepção sido herdada do Código Civil de 1916. Todavia, estudos têm demonstrado que estes são seres sencientes, capazes de distinguir objetos, animais e situações. Por essa razão, o Deputado Ricardo Izar (PSD-SP), apresentou o Projeto de Lei no 6054/2019 (antigo PL no 6799/2013) ao Plenário, visando a modificação do status jurídico dos animais não-humanos para sujeitos de direitos despersonificados, garantindo-lhes o direito de serem representados na Justiça em caso de violações. O presente trabalho pretende analisar a proposta normativa inicial, as suas modificações e a sua viabilidade, bem como, o avanço do Direito Animal na legislação brasileira e nas jurisprudências. |
| Abstract: | Under the art. 82 of the Brazilian Civil Code, animals are considered movable property capable of their own movement, and this conception was inherited from the Civil Code of 1916. However, studies have shown that these are sentient beings, capable of distinguishing objects, animals and situations. For this reason, Deputy Ricardo Izar (PSD-SP), presented Bill no 6054/2019 (former PL no 6799/2013) to the Plenary, aiming at modifying the legal status of non-human animals for subjects with disembodied rights, guaranteeing them the right to be represented in court in case of violations. The present work intends to analyze the initial normative proposal, its modifications and its viability, as well as the advance of Animal Law in Brazilian legislation and jurisprudence. |
