A instrumentalidade da mediação transformativa na governança das empresas familiares: construção do protocolo familiar e técnicas aplicáveis

Abstract

The present monograph critically approaches the viability of the application of mediation as a governance tool in family businesses. By means of a critical dialectic bibliographic methodology and under the aegis of Transformative Mediation, it has examined the suitability of the aforementioned current and its objectives in the business and family areas, initially understood in an unrelated manner, for further analysis of the Family Business phenomenon and the suitability of Transformative Mediation to its context, peculiarly marked by the intersection between business and affective bonds. Furthermore, for a correct understanding of the theme, the concept and approach to governance were delimited, as well as its governing principles. Then, the particularities of governance in Family Businesses were studied, specifically structured by three overlapping, although independent subsystems, namely, family, property, and management. In this path, the adequacy of Transformative Mediation was verified as a tool capable of ensuring governance in Family Businesses, considering the demand for balance among the axes, alignment of interests, needs and expectations, as well as constant dialogue. For this reason, a Family Protocol was proposed, with its objectives and basic items, which should also be structured by the explained mediation techniques, applied from a transformative perspective, as well as link these techniques as ways of preventing and solving conflicts inherent to Family Businesses, in order to ensure governance, the effectiveness of good practices, longevity, and the success of these organizations.
