O tratamento dos exames criminológicos nas decisões judiciais do juízo da execução penal da comarca de Governador Valadares

Abstract

In order to verify the propensity to commit new crimes and to attest to the resocialization of incarcerated people, the criminological examination is used by analyzing the subjectivity of the individual for the purpose of regime progression. However, what happens is the total deprivation of liberty for a longer period than that foreseen at the moment when the condemnatory criminal sentence was handed down, added to the real desocializing function of incarceration in the light of critical criminology. In view of this, the present work is an empirical research, through public documents, which are the interlocutory decisions of the Criminal Execution Court of Governador Valadares, with the objective of understanding the use of criminological examinations by the Criminal Execution Court of Governador Valadares when there is a possibility of regime progression. The research is preceded by an analysis of theoretical references from the criminological school that provided bases for understanding the context in which the exam was carried out, as well as the legislation, jurisprudence and the position of professionals in the field of psychology.
