Depoimento policial e a construção da verdade nos processos que apuram a prática do tráfico de drogas

Abstract

Initiated the article dealing with the guarantees inherent to the criminal process, the evidentiary activity of the parties and the reasoning of decisions in order to determine the truth to be allegedly not processed. From the examination of the empirical research carried out, it is intended to examine two police stations in a special way in search of the truth of two occurrences in the processes involving drug trafficking. Confirmation or special value conferred, especially in view of their presumption of veracity. It is shown, however, that this exacerbated value is largely unsustainable, and that both the Testimony and the Police are susceptible to factors of voluntary and involuntary contamination that weaken and tarnish the reliability of the evidence in the reconstruction of the two fatalities. It was concluded, despite the protagonism and predominance of the word police, for its relative value, under penalty of making it absolute proof, not judgment, or that it would affront the presumption of innocence of the accused.
