| Resumo: | Essa presente monografia trata sobre a figura necessária do juiz de garantias, que atua na fase pré-processual garantindo os direitos individuais dos suspeitos e controlando a legalidade da investigação criminal. Com base na Jurisprudência nacional e internacional e obras nacionais chegaremos a conclusão que o Brasil deve seguir a tendência dos demais países latino-americanos em incorporar em seu ordenamento a figura mencionada como forma de se conseguir uma justiça imparcial como demanda o Estado democrático de direito. |
| Abstract: | This monograph deals with the necessary figure of the judge of guarantees, who acts in the pre-procedural phase guaranteeing the individual rights of suspects and controlling the legality of the criminal investigation. Based on National and International Jurisprudence and National Works, we will come to the conclusion that Brazil must follow the trend of other Latin American countries to incorporate the aforementioned figure in their legal system as a way of achieving impartial justice as demanded by the Democratic State of Law. |
