| Resumo: | A presente pesquisa intenta averiguar a constitucionalidade (ou não) da execução provisória da pena no Tribunal do Júri, conforme determinação do artigo 492, inciso I, alínea e, do Código de Processo Penal, na redação conferida pela Lei nº 13.964/19. Para tanto, investiga-se a compatibilidade do dispositivo legal com as garantias fundamentais da presunção de inocência e do duplo grau de jurisdição, e a validade da soberania dos veredictos como um argumento para justificar a execução antecipada da pena. |
| Abstract: | This research aims to investigate the constitutionality (or not) of the provisional execution of the sentence in the Jury Tribunal, as determined by article 492, item I, line e, of the Code of Criminal Procedure, as amended by Law 13.964/19. To this end, the compatibility of the legal provision with the fundamental guarantees of presumption of innocence and double degree of jurisdiction is investigated, as well as the validity of the sovereignty of verdicts as an argument to justify the early execution of the sentence. |
