Os animais não humanos como sujeitos de direito? o projeto de lei nº 27 de 2018 da Câmara dos Deputados Juiz de Fora 2021

Abstract

As a result of the expansion of philosophical questions about the treatment given by humanity to non-human animals, the social longing for changes in Law that combat the abuses committed against them has also expanded. In this scenario, one of the demands that has gained strength is the attribution of rights to non-human animals, and, in Brazil, this possibility is now presented through the House Bill No. 27 of 2018. This work aims to verify if this potential change is positive for animals. Therefore, it analyzes the moral and practical relevance of attributing rights to these beings, and then, concluding for the importance of such a measure, it analyzes the Brazilian context in which the referred H.R. is inserted, as well as the wording given to it. Through the reflections made, it was concluded that the conversion of the H.R. No. 27/2018 into law is positive for the animal cause despite its inconsistencies, since these tend to be resolved through the Judiciary.
