| Resumo: | O objetivo do presente trabalho é analisar o instituto dos negócios jurídicos processuais atípicos, em seus aspectos gerais e específicos, e, sobretudo, sua incidência em procedimentos especiais. Através de uma pesquisa científica teórica, de cunho metodológico de feição dedutiva, buscou-se compreender a origem e a razão de se introduzir uma cláusula geral de negociação processual no Código de Processo Civil de 2015, com fundamento no autorregramento das partes. Foram estudados os conceitos, requisitos de validade, objetos e limites do fenômeno processual. Por fim, levando-se em consideração os princípios gerais do ordenamento jurídico, bem com as peculiaridades existentes nos procedimentos especiais, demarcaram-se os contornos da celebração dos negócios jurídicos processuais atípicos em tais vias. |
| Abstract: | The objective of this work is to analyze the institute of atypical procedural legal transactions, in its general and specific aspects, and, above all, its incidence in special procedures. Through a theoretical scientific research, of a deductive methodological nature, we sought to understand the origin and the reason for introducing a general clause for procedural negotiation in the 2015 Code of Civil Procedure, based on the self-regulation of the parties. The concepts, validity requirements, objects and limits of the procedural phenomenon were studied. Finally, taking into account the general principles of the legal system, as well as the peculiarities existing in the special procedures, the contours of the celebration of atypical procedural legal transactions in such ways were demarcated. |
