| Resumo: | O presente estudo objetivou, a partir dos estudos de Michel Foucault, compreender qual o papel da narrativa policial na distinção entre usuário e traficante, tendo em vista os critérios estabelecidos pela Lei 11.343/2006. Para tanto, propôs-se um caminho metodológico baseado na pesquisa explicativa, a partir dos métodos de revisão de literatura e de análise documental quantitativa e qualitativa. Inicialmente, traçou-se um panorama histórico do proibicionismo, buscando contextualizar a edição da Lei 11.343/2006 e os critérios estabelecidos por ela para distinção entre o usuário e o traficante, para, então, identificar o papel do policial nesta distinção. Na sequência, foi realizada a análise acórdãos proferidos pelo Tribunal de Justiça de Minas Gerais, a partir da qual pode-se traçar inferências que levaram às conclusões apresentadas. |
| Abstract: | The present paper, based on Michel Foucault's studies, is aiming to understand the role of police narrative in the distinction between user and drug dealer, according to the Federal Law 11.343/06 (Anti-Drug Act). Anchored on an explanatory reasearch, this work focused on literature review and qualitative and quantitative documental analysis. This research starts with a historical overview of prohibitionism, in the context of the conception of the Federal Law 11.343/06 (Anti-Drug Act), which used a strict criteria to distinguish the user and the drug trafficker. Furthermore, this paper tried to analyse the role of the police in this distiction. Afterwards, a study of the judgments rendered by the Court of Justice of Minas Gerais was carried out, from which a inferencial process was conducted, leading to the paper's conclusion. |
