A adoção de crianças por casais homoafetivos no Brasil: evolução e desafios

Abstract

The issue of homosexuality has been conquering important spaces in the media and gaining necessary visibility. Despite an apparently favorable context and growing recognition by the Brazilian legal system, the issue of the adoption of children and adolescents by homosexual couples is a reason for intense debates, even with the recognition of the same-sex stable union and its right to parenthood by through adoption. Over time, the family institution has undergone changes in its structure, with these changes a new family formation has emerged, this family has brought the possibility of children who until then disbelievers of an adoption form a family with affection, love and respect. Despite the homoaffective union already being a pacified theme, the joint adoption by same-sex couples still does not have legal support expressed in the legislation. In this sense, the present work deals with the adoption of children by homosexual couples, emphasizing the possibility of the emergence of a new family, as well as the evolution, the challenges of this possibility, and the effects on the adopted.
