A invisibilidade das famílias dos indivíduos privados de liberdade: ouvindo suas vozes. Um estudo crítico sobre o sistema prisional.

Abstract

The present dissertation has the objective of analyzing the place that the relatives of individuals deprived of liberty occupy in the imprisonment process from their speeches. The study was carried out with the relatives of individuals deprived of liberty who experience the prison experience in their realities. For that, a field work was carried out, in the surroundings of the Penitentiary of Juiz de Fora I - Professor José Edson Cavaliere (Juiz de Fora/MG), using the semi-structured interview and observation as a form of data collection. From the analysis of the interviewees' statements, we were able to capture important elements that allowed us to approach more reliably a reality rich in determinations and a more attentive reflection on the dynamics and historicity of social facts. In order to achieve our objective, we understand that it was necessary to analyze the historical foundations of the punitive system in capitalist society, the class position assumed by the State and how this institution is positioned in the face of the criminal issue. We start from the understanding that the forms of social control are related to the interest and development of the productive forces in a society. The advance of the capitalist accumulation process has made the gap between wealth and misery even greater, accentuating and recreating new expressions of the social question, with incarceration being one of the most complex faces of this process, as it brings together deep marks of social, racial inequality. , economic, class, gender, age and unemployment. We understand that the perversity of this phenomenon is advancing on the selectivity of the penal system. We also seek to address the Brazilian historical particularities and resort to statistical data to identify the profile of the prison population in Brazil in order to understand who is the public that makes up the penitentiary system and what critical reading these data bring us. This also allowed us to approach our object of study: the family of the individual deprived of liberty. In a second moment, we contextualize the process of accountability that falls on families in the scenario of restructuring the functions of the State in capitalist society and we seek to identify the role of the family in the prison dynamics from the legal and affective aspect.
