| Resumo: | O presente trabalho de pesquisa qualitativa e análise bibliográfica demonstra a problemática existente em relação a ausência de parâmetros para a concessão judicial do benefício da justiça gratuita e como isso pode se tornar um entrave ao direito fundamental de acesso à justiça, sob a ótica do Estado Democrático de Direito. Para isso, são abordadas as ondas renovatórias de Cappelleti e Garth, além da evolução no ordenamento jurídico brasileiro sobre o assunto, analisando a Constituição Federal, a Lei de Assistência Judiciária – no 1.060/1950 e o Código de Processo Civil de 2015 - Lei 13.105/2015. Ao final, são exemplificados critérios que podem ser fixados, dada a necessidade de complementação da legislação existente, vez que atenderia ao processo jurisdicional democrático e asseguraria a efetivação das garantias constitucionais. |
| Abstract: | The present work of qualitative research and bibliographic analysis demonstrates the existing problem in relation to the absence of parameters for the judicial granting of the benefit of free justice and how this can become an obstacle to the fundamental right of access to justice, from the standpoint of the Democratic State of Law. For this, the renovatory waves of Cappelleti and Garth are addressed, in addition to the evolution in the Brazilian legal system on the subject, analyzing the Federal Constitution, the Legal Aid Law - No. 1060/1950 and the Civil Procedure Code of 2015 - Law 13105/2015. At the end, criteria that can be set are exemplified, given the need to complement the existing legislation, since it would meet the democratic jurisdictional process and ensure the effectiveness of constitutional guarantees. |
