Title: A utilização de ilhas artificiais autossustentáveis em âmbito de domínio público internacional para acolhimento provisório de refugiados de guerra

Resumo: Este trabalho trata a crise dos refugiados e projetos para solucioná-la. Para isso, utiliza como metodologia análise de dados, referentes ao refúgio, e análise de conteúdo por meio do exame de possíveis soluções já propostas. As propostas verificadas possuem como objeto em comum a utilização de ilhas artificiais para o acolhimento de refugiados. Nessas propostas, foram observadas e apontadas semelhanças, diferenças, qualidades que podem ser seguidas e defeitos que devem ser descartados. Assim, o trabalho pretende propor uma nova solução para a crise dos refugiados, se apresentando como uma versão aprimorada em relação as demais. A proposta baseia-se na construção de ilhas artificiais autossustentáveis para o acolhimento provisório de refugiados de guerra, apresentando como diferencial o fato de que as ilhas sugeridas teriam característica de Domínio Público Internacional. Essa diferença significaria que as ilhas não estariam submetidas a nenhuma soberania Estatal, mas teriam leis próprias podendo ser regidas pelas Nações Unidas por meio da cooperação internacional, maneira pela qual também seriam criadas. O trabalho também inova ao propor que essas ilhas sejam construídas em águas internacionais, mas o mais próximo possível dos países com maiores números de refugiados, sendo cada ilha voltada para um povo específico, facilitando o acesso ao local para diminuir as mortes nos mares. Dessa forma, este trabalho almeja que refugiados não sejam dependentes de arbítrios estatais para que tenham acesso ao refúgio, mas que tenham seus direitos básicos garantidos. Conclui-se que o projeto proposto atenuaria a crise de refugiados, mas não seria suficiente por si só, sendo necessárias futuras soluções.
Abstract: This paper concerns the refugee crisis and projects to solve it. For this, it uses as methodology data analysis regarding refuge and content analysis through the examination of possible solutions already proposed. The verified proposals have as common object the utilization of artificial island for refugees’ reception. In these proposals, were observed and pointed similarities, differences, qualities that can be followed and flaws that must be discharged. This way, the paper pretends to propose a new solution for the refugee crisis presenting itself as an improved version regarding the others. The proposal is based upon the construction of self- sustainable artificial islands for the provisory reception of war refugees, presenting as differential the fact that the suggested islands would have the characteristic of International Public Domain. This difference would mean that the islands wouldn’t be submitted to any State sovereignty but would have its own laws being able to be governed by the United Nations through international cooperation, the manner in which they would also be created. The study also innovates by proposing the construction of these islands in international waters, but the closest as possible from the countries with the largest numbers of refugees, being each island directed to the people of a specific nation, facilitating the access to the local in order to reduce deaths at sea. Therefore, this paper aims that refugees don’t be reliant of States wills to have access to refuge, but have their basic rights guarantee. Concludes that the project proposed would attenuate the refugee crisis, but wouldn't be enough on its own, so future solutions are needed.
