| Resumo: | O presente trabalho tem como objetivo a análise da Medida Provisória 984/2020, vulgarmente conhecida como a “MP do mandante”, que visava a alteração da redação da lei 9.615/98 (Lei Pelé), mais especificamente no que tange ao direito de comercialização de imagem das práticas esportivas no Brasil, sobretudo no que tange aos jogos de futebol. A referida análise crítica, basear-se-á no papel exercido pelo Clube de Regatas do Flamengo como uma instituição em busca de seus direitos, demonstrando como um clube reestruturado financeiro e administrativamente tem a capacidade de alterar padrões do establishment esportivo televisivo, findando, mesmo que a Medida Provisória tenha “caducado”, com o monopólio de transmissão, pertencente ao Grupo Globo. Analisar-se-á, também, a escolha da Medida Provisória como remédio jurídico cabível para a efetivação da pretensão dos clubes. |
| Abstract: | This paper aims to analyze Provisional Measure 984/2020, commonly known as the “PM of the client”, which aimed at changing the wording of Law 9.615 / 98 (Lei Pelé), more specifically with regard to the right to commercialize image of sports practices in Brazil, especially with regard to football games. The aforementioned critical analysis will be based on the role played by the Clube de Regatas do Flamengo as an institution in search of its rights, demonstrating how a financially and administratively restructured club has the capacity to change standards of the television sports establishment, ending, even that the Provisional Measure has “expired”, with the transmission monopoly, often belonging to Grupo Globo. The choice of the Provisional Measure will also be analyzed as a legal remedy to make the clubs claim effective. |
