| Resumo: | O presente trabalho objetiva a análise do inciso III adicionado ao artigo 62 da CLT (BRASIL, 1943) pela Lei 13.467/2017 (BRASIL, 2017), segundo o qual os empregados em regime de teletrabalho não se submetem ao controle de jornada. A partir da visão de Márcio Túlio Viana sobre as alterações nos modos de produzir e de trabalhar no século XXI, questiona-se a compatibilidade da norma com o atual estado de desenvolvimento das tecnologias e com o princípio constitucional da dignidade humana e o direito fundamental à desconexão do trabalho. A partir das informações adquiridas em pesquisa bibliográfica e jurisprudencial, concluiu-se que o dispositivo é inconstitucional e incompatível com orientações internacionais, propondo-se algumas alternativas para concretização da desconexão do teletrabalhador. |
| Abstract: | This work aims at analyzing item III added to article 62 of the CLT (BRAZIL, 1943) by Law 13.467/2017 (BRAZIL, 2017), according to which employees on a telework basis are not subject to the day control. From Márcio Túlio Viana's view on the changes in the ways of producing and working in the 21st century, the compatibility of the norm with the current state of development of technologies and with the constitutional principle of human dignity and the fundamental right to work disconnection is questioned. Based on the information acquired in bibliographic and jurisprudential research, it was concluded that the device is unconstitutional and incompatible with international guidelines, proposing some alternatives to materialize the disconnection of the teleworker. |
