| Resumo: | O presente trabalho tem por objetivo avaliar o dever de observância dos precedentes judiciais no âmbito da arbitragem, tendo em vista a lacuna legislativa a respeito da questão. Para tanto, analisa-se, em um primeiro momento, sob a perspectiva do sistema multiportas, o regime jurídico da arbitragem no ordenamento brasileiro, considerando-se as disposições da Lei nº 9.307/96. Em seguida, passa-se ao estudo do sistema de precedentes judiciais do Código de Processo Civil e sua aplicação na esfera do Poder Judiciário. Por fim, verifica-se em que medida e sob que circunstâncias a atuação dos árbitros estaria vinculada aos precedentes judiciais, ponderando-se acerca do cabimento de ação anulatória contra sentença arbitral, em caso de inobservância de precedentes vinculantes. |
| Abstract: | The present work aims to evaluate the duty of observance of judicial precedents in the scope of arbitration, in view of the legislative gap regarding the issue. To this end, the legal regime of arbitration in the Brazilian system is analyzed, from the perspective of the multidoor courthouse system, considering the provisions of Law No. 9.307/96. Then, the system of judicial precedents of the Code of Civil Procedure and its application in the sphere of the Judiciary is studied. Finally, it is verified to what extent and under what circumstances the performance of the arbitrators would be linked to the judicial precedents, considering the appropriateness of the annulment action against the arbitral award, in case of non-observance of binding precedents. |
