| Resumo: | Neste presente trabalho, nos propomos a analisar as origens e os possíveis problemas da prática do plea bargaining na experiência jurídica norte-americana. Para tanto, nos utilizamos, principalmente, da doutrina crítica norte-americana e brasileira. A partir desta análise, objetivamos precisar se a aplicação dos institutos de justiça penal negociada no Brasil possui fundamento legítimo, dentro de um Estado Democrático de Direito, ou apenas representa mais uma forma de perpetuação da lógica criminal punitivista. |
| Abstract: | In this present work, we propose to analize the beginnings and the possible problems of the practice of plea bargaining, based on the american judicial experience. To do so, we were aided by the works of american and brazilian critical doctrines. Our goal, through this analysis, is to precise wether the practice of plea bargaining in Brazil has any legitimate fundaments, within a Democratic State of Law, or just represents another form of perpetuating the logic of criminal punitivism. |
