| Resumo: | O presente artigo tem por objetivo estudar os impactos que podem ser causados pela aprovação do Projeto de Lei Anticrime, em especial no tocante à exclusão de ilicitude por legítima defesa, que mostra-se a priori uma ampliação nas possibilidades de justificativa para a letalidade policial, utilizando como marco teórico as hipóteses de Günther Jakobs sobre o direito penal do inimigo. Apresenta-se ainda dados sobre as mortes por agentes de segurança no Brasil, Rio de Janeiro e São Paulo, bem como um caso que ilustra tais ações. |
| Abstract: | The purpose of this article is to study the impacts that may be caused by the approval of the Anti-Crime Bill, especially regarding the exclusion of unlawfulness due to self-defense, which shows a priori an increase in the possibilities of justification for police lethality, using as theoretical framework the hypotheses of Günther Jakobs on the criminal law of the enemy. Data are also presented on deaths by security agents in Brazil, Rio de Janeiro and São Paulo, as well as a case that illustrates such actions. |
