| Resumo: | O presente trabalho possui, como temática central, a incidência de crimes digitais no Brasil e o atual estado da legislação brasileira na tipificação e combate a este tipo de crime. Nesse sentido, foram investigadas as leis que introduziram este objeto jurídico no ordenamento brasileiro, bem como foram apontadas quais demandas fizeram florescer, no país, estas leis. É apontada a centralidade do Marco Civil da Internet na tipificação de crimes cometidos na rede, assim como são discutidas quais as consequências oriundas, no universo jurídico, desde a sua entrada em vigência. Adiante, mesmo reconhecendo o valor das iniciativas já vigentes em nosso ordenamento jurídico, é salientada a necessidade de atualização da legislação penal quanto à tipificação de crimes cibernéticos. |
| Abstract: | The present work has, as a central theme, the incidence of digital crimes in Brazil and the current state of Brazilian legislation in the typification and combat of this type of crime. Thus, the laws that introduced this legal object in the Brazilian system were investigated, as well as which demands made these laws flourish in the country. The centrality of the Internet Civil Landmark is pointed out in the typification of crimes committed on the network, as well as the consequences arising in the legal universe, since its entry into force, are discussed. Later, even recognizing the value of the initiatives already in force in our legal system, the need to update criminal law on the typification of cybercrime is stressed. |
