| Resumo: | O capitalismo ligado ao fenômeno da globalização propiciou o vertiginoso crescimento de investimentos globais, isto é, não mais limitados ao território nacional do investidor. Com isso, a acentuada relação Investidor/Estado culmina no desenvolvimento de um sub-ramo do Direito Internacional, qual seja, o Direito Internacional dos Investimentos. O presente trabalho objetiva discorrer acerca da temática e dos seus principais pontos de alcance para, portanto, apresentar breve estudo de caso no qual é possível verificar na prática todo o conteúdo debatido. Para tanto, além da pesquisa bibliográfica pertinente, recorre-se a Tratados Bilaterais de Investimento e decisões arbitrais para fomentar análise jurídica consistente. |
| Abstract: | Capitalism connected to the phenomenon of globalization conducted the vertiginous growth of global investments, therefore, no more limited to the national territory of the investor. Thereby, the accentuated Investor/State relation culminates in the development of the International Investment Law. This article aim to discourse about the subject and the main aspects to, therefore, present a brief case study where will be possible to verify in practice all the debated content. Finally, besides bibliographical research, this work will examine Bilateral Investment Treats and arbitral decisions to promote a consistent legal analysis. |
