Análise do instituto de alienação parental na perspectiva da sociedade brasileira contemporânea

Abstract

The present work seeks to reflect on the institute of parental alienation based on a bibliographical survey, as well as a conceptual and practical study of the Brazilian legislation that permeates the main concepts of family law and how it is approached today. It has also permeated by the role played by the family in society and how society in its historical and ideal moments interfere in the formation of the family structure and how these relations directly influence the life and effective prevalence of the best interests of children and adolescents advocated by the Constitution of the Federative Republic of Brazil. Finally, advances were made on the subject, but also conjectures about possible improvements regarding the integral protection and the institute of the parental alienation in the face of problems and setbacks presented by the most diverse actors involved in the subject and concluding that, despite facing problems, the Brazilian legislation on the subject is a real advance and must be maintained and should be improved in practice.
