| Resumo: | O presente artigo tem por objetivo analisar a aplicabilidade do negócio jurídico processual nos procedimentos especiais, tendo em vista a cláusula aberta trazida pelo novo Código de Processo Civil em seu artigo 190. O trabalho partirá da trajetória do instituto no CPC/73 onde já se permitia acordos processuais entre as partes, desaguando na consequente inovação do código vigente. Com o novo formato do instituto, demonstra-se que sua aplicabilidade não encontra obstáculos nos procedimentos especiais mesmo sendo marcados por regras específicas de tramitação, por técnicas processuais distintas e por limitação de matéria, geradores de igual cognição limitada, no plano horizontal, desde que não o desnature. |
| Abstract: | The purpose of this article is to analyze the applicability of the procedural legal business in the special procedures, in view of the open clause brought by the new Code of Civil Procedure in its article 190. The work will start from the trajectory of the institute in CPC / 73 where it was already allowed procedural agreements between the parties, resulting in the resulting innovation of the existing code. With the new format of the institute, it is demonstrated that its applicability does not find obstacles in the special procedures even though they are marked by specific rules of procedure, by different procedural techniques and by limitation of matter, generators of equal cognition limited, in the horizontal plane, provided it does not. |
