| Resumo: | O presente trabalho tem como objetivo analisar a responsabilidade penal da pessoa jurídica à luz dos direitos humanos. Com cerne no avanço da nova criminalidade em face dos bens jurídicos supraindividuais e no papel desempenhado pelos entes jurídicos, na medida em que também devem preservar a dignidade do homem, verifica-se que o aparato penal tem sido solicitado para proteger a nova ordem social instaurada, a partir do reconhecimento das pessoas jurídicas como sujeitos aptos a delinquirem. Pautada na noção de conduta social, propõe-se a construção de uma nova teoria do crime que possibilite a responsabilização do ente moral por atos ilícitos. |
| Abstract: | The present work has the purpose of analysing the criminalnal liability oh the legal person in front of the human rights. With focus on the advance of the new criminality in the new collective legal assets and the role played by the juridic institutes, in the way that they also have to preserve the human's dignity, in which you can see that the criminal system has been called to protect the new social order that should recognize the legal person as possible offenders. Starting from the notion of social action, it is proposed the construction of a new crime theory that allows the liability of forbidden actions to the moral institute. |
