Responsabilidade penal da pessoa jurídica: uma abordagem à luz dos direitos humanos

Abstract

The present work has the purpose of analysing the criminalnal liability oh the legal person in front of the human rights. With focus on the advance of the new criminality in the new collective legal assets and the role played by the juridic institutes, in the way that they also have to preserve the human's dignity, in which you can see that the criminal system has been called to protect the new social order that should recognize the legal person as possible offenders. Starting from the notion of social action, it is proposed the construction of a new crime theory that allows the liability of forbidden actions to the moral institute.
