Questão social e medidas socioeducativas: uma análise das formas de intervenção do Estado na questão da infância e juventude no Brasil

Abstract

In this work, we aim to contextualize the state intervention on the issues related to childhood and youth in Brazil approaching the different legislations and institutions aimed at this public across a variety of historical moments. By appointing aspects of Brazilian social formation, we perceive how the relationship between State and Civil Society impacts the social issue and living conditions of childhood and youth, noting relevant transformations over time. Firstly, a punitive approach prevailed, where children and teenagers were frequently subjected to coercive measures and stigmatizing. However, with advancements in discussions about human rights and social mobilizations, there has been a transition to a protection model, determined by the “Estatuto da Criança e do Adolescente” (ECA). This chance implies recognizing children and teenagers as a subject of rights, demanding that the State take on the role of protector and guarantor of these rights. Through this study we will look to understand how these treatment models have impacted the lives of this public, focussing on socio-education measures. In this current overview, we will provide a brief analyses of the most recent annual collection from “Sistema Nacional de Atendimento Socioeducativo (SINASE)” for 2023, highlighting how the socioeducation measure have been materialized in contemporary times.
