| Resumo: | O trabalho tem como objeto analisar a prática de violência doméstica por adolescentes e um possível diálogo entre a Lei 11.340/06 (Lei Maria da Penha) e a Lei 8.069/90 (Estatuto da Criança e do Adolescente), evidenciando suas consequências jurídico-penais. Para tanto, faz-se uma revisão da literatura na área e traça-se a evolução histórica dessas duas legislações, a fim de refletir sobre a ordem proeminente patriarcal existente no Brasil e sua relação com a prática de violência doméstica durante a adolescência. Finalmente, defende-se a importância do convívio familiar para o desenvolvimento pessoal e social do adolescente e a necessidade de se repensar as respostas marcadamente punitivas até então dadas pelo Estado a essa prática, sejam elas amparadas pelas medidas protetivas da Lei n° 11.340/06 (Lei Maria da Penha) seja elas na forma da medida socioeducativa de internação prevista na Lei n° 8.069/90 (Estatuto da Criança e do Adolescente). |
| Abstract: | The study aims to analyze the practice of domestic violence by adolescents and analyzes a possible dialogue between Law 11.340 / 06 (Maria da Penha Law) and Law 8.069 / 90 (Child and Adolescent Statute), evidencing its legal- criminal proceedings. To do so, a review of the literature in the area is made and the historical evolution of these two legislations is traced to reflect on the prevailing patriarchal order in Brazil and its relation to the practice of domestic violence during adolescence. Finally, the importance of family life for the adolescent's personal and social development and the need to rethink the punitive responses hitherto given by the State to this practice, whether protected by the protective measures of Law No. 11.340 / 06 (Lei Maria da Penha) are in the form of the socio-educational measure of hospitalization provided for in Law n ° 8.069 / 90 (Statute of the Child and Adolescent). |
