A religiosidade na execução penal: um caminho para a ressocialização?

Abstract

This monograph aims to describe the general panorama of Brazilian criminal execution, demonstrating its inconsistency with the Law on Criminal Executions. Faced with an unwanted scenario of punishment in Brazil, this papel will observe how religiosity can serve as a mechanism to relieve prisoner tensions. Furthermore, viewing the secularity of the State and the presence of religious institutions in prisons, the concept of secular state will be demystified, bringing the differences of an atheist state and a denominational state. Therefore, the study will briefly digress through the constitutions existing in the history of Brazil as an independent State. From this first perspective, the monograph will use human dignity as a theoretical framework to defend the principle of humanity in Brazilian criminal enforcement. Afterwards, the analysis of the religiosity in prison environments will be carried out in view of its influence on the prisoner 's reintegration process, through the observation of prison chaplaincy in the city of Belo Horizonte - MG and the APAC method in the city of Itaúna - MG. The methodology used in this study draws on an Explorer, when working on the existing biography, descriptive research, when collecting data on the criminal execution in the country, and ethnographic, research with field. The assignment brings a "quali-quanti" approach, a analyzing concrete cases, such as testimonies of people involved with the prison system, proving that the religiosity experienced in prison units respects and promotes the dignity of the human person, assisting in the region resocializer process.
