| Resumo: | O instituto constitucional do estado de sítio foi criado na França durante o período revolucionário do final do século XVIII. A elaboração jurídica ganhou grande repercussão internacional e passou a integrar a maioria das legislações do mundo. Utilizado em demasia no país de origem e em várias outras localidades no decorrer do século XIX, o Brasil vivenciou a sua mais recorrente experimentação na vigência da sua Primeira República (1889-1930), quando o instituto foi expresso em uma Constituição brasileira pela primeira vez. Este trabalho visa situar a posição do Brasil em relação a um cenário internacional de formulação e utilização do estado de sítio, bem como verificar qual foi a implicância do instituto para a construção do sistema republicano e da democracia no país. |
| Abstract: | The constitutional institute of state of siege was created in France during the revolutionary period in the end of XVIII Century. The juridical elaboration gained great international repercussion, integrating the most part of legislations in the world. Overplus used in France and in many other countries during the XIX Century, the Brazilian most recurrent experimentation happened in the time of its First Republic (1889-1930), when the institute was expressed for the first time in a Brazilian Constitution. This research aims to situate the Brazilians position in an international context of formulation and use of the state of siege, as well as to verify the importance of the institute to the construction of the republican system and the democracy in Brazil. |
