| Resumo: | O artigo analisa o instituto da licença maternidade e discute se este, nos moldes atuais, consegue resguardar satisfatoriamente os casos de partos prematuros. Para tanto, realizou-se um estudo teleológico da norma, a fim de se verificar o porquê da sua existência. Após identificado o arcabouço justificador da Licença Maternidade, buscou-se analisar se o instituto abarca os casos dos filhos prematuros. Respondida a questão, passou-se o foco à PEC 181-2015, que visa estender o prazo da licença, nos casos de prematuridade do parto, aos dias em que o bebê ficou internado. Por fim, pontuou-se acerca da justeza da proposta. |
| Abstract: | The article analyzes the maternity leave institute and discusses whether it, in the current molds, is able to satisfactorily protect the cases of premature birth. For that, a teleological study of the norm was carried out, in order to verify the reason for the doubt. After the diagnosis, the justifying framework of the Maternity Leave, the aim was to analyze if the institute covers the cases of premature children. Once the question is answered, focus on PEC 181-2015, which refers to the term of leave, in cases of premature delivery, on the days when the baby was hospitalized. Finally, he pointed out the correctness of the proposal. |
