| Resumo: | O presente trabalho tem por objetivo analisar a Lei de Drogas, nº 11.343/06 e seus reflexos na população carcerária brasileira, expondo os subjetivismos em seus critérios de diferenciação, que acabam por ocasionar uma dificuldade em distinguir o usuário do traficante, deixando nas mãos das autoridades competentes a definição do tipo penal a partir do caso em concreto. Isto leva à imposição de alta carga de subjetivismo e seletividade a partir da existência de estigmas sociais, problema este exemplificado no presente trabalho a partir da análise de inquérito e decisões judiciais. Será exposto, ainda, os métodos existentes de diferenciação do usuário do traficante e como os mesmos são aplicados no Brasil e em outras legislações estrangeiras, especialmente na portuguesa. Por fim, serão trazidas formas de solução do problema apresentado, na busca por um sistema mais justo e igualitário, em que se chegue a uma política mais efetiva de combate ao verdadeiro traficante de drogas, evitando-se o enquadramento de usuários como traficantes. |
| Abstract: | The objective of this study is to analyze the Drug Law, nº 11.343 / 06 and its reflexes in the Brazilian prison population, exposing the subjectivisms in their criteria of differentiation, which end up causing a difficulty in distinguishing the user from the drug dealers, letting the criminal authorities decide on a definition of the criminal type from the specific case. What led to the imposition of high subjectivity and selectivity from the situation of social stigmas, this problem was not found at the time of analysis of lawsuits and decisions. It will also be exposed the methods to differentiate users of the drug dealers and how they are applied in Brazil and other foreign legislation, especially in Portuguese. Finally, it will bring forms of solution to solve problems, in the search for a fairer and egalitarian system, in which a more effective policy to combat the true drug dealer, avoiding the framing of users as traffickers. |
